July 05, Colombo: The Commercial High Court of Colombo announced today that the order regarding the Attorney General’s request to reject the case related to the Russian Aeroflot aircraft will be announced on the 15th.
The case in which an injunction was issued preventing the Aeroflot plane from leaving the country was called today before Commercial High Court Judge Sumit Perera.
The hearing was scheduled to be held regarding the requests for the interim restraining order related to the case.
The President’s Counsel appearing for the petitioner, stated before the court that the request for the interim order related to the case will be withdrawn.
Accordingly, the judge ordered to dismiss the application for the interim injunction.
Additional Solicitor General Mr. Sumathi Dharmawardena, who appeared on behalf of the Attorney General, asked the court to dismiss the case without taking it to trial, and the petitioner objected to it.
The Additional Solicitor General also stated that according to the existing agreements between Russia and Sri Lanka, the court has no authority to issue such an injunction.
The court informed that the order regarding the request made by the respondent party to dismiss the case will be announced on the 15th.
The Colombo Commercial High Court issued the enjoining order on the 2nd June on the Russian airline after hearing a complaint filed by Celestial Aviation Trading Limited in Ireland.
Following the legal action detaining its Airbus A330 jet, Russia’s Aeroflot airline suspended its flights to Sri Lanka.
