June 28, Colombo: Sri Lanka’s Attorney General today requested the Colombo Commercial High Court to dismiss the case filed by an Irish company against the Russian Aeroflot aircraft.
When the case was taken up before Colombo Commercial High Court Judge Harsha Sethunga today, Additional Solicitor General Sumathi Dharmawardena appearing for the Attorney General said If further orders are issued by a Sri Lankan court regarding the Aeroflot aircraft, it would be contrary to the Sri Lankan state policy.
Additional Solicitor General Sumathi Dharmawardena said this could be detrimental to the bilateral agreements reached between the Government of Sri Lanka and the Government of Russia.
He also alleged that the agreements reached between the two sides to allow Russian aircraft to enter and fly freely in Sri Lanka have been breached.
Additional Solicitor General Sumathi Dharmawardena has noted that the complainant Irish Company abusing jurisdiction, concealed facts from court and obtained an injunction restraining Russian aircraft from leaving Sri Lanka and said the case could not be continued as the enjoining order has been dissolved by the court.
The lawyer representing the accused Aeroflot Airlines informed the court that the aircraft had left for Russia after the injunction was lifted but so far no Russian aircraft has been able to land in Sri Lanka.
After considering the submissions made by the Additional Solicitor General and the defendants, the Commercial High Court Judge ordered that the case be heard on the 5th of this month and that an order be issued thereafter.
