* UNP hands over no-confidence motion against appointment of Rajapaksa as PM

Nov 02, Colombo: The United National Party says it has handed over a No Confidence Motion to Speaker of House Karu Jayasuriya, against the appointment of Mahinda Rajapaksa as the Prime Minister.

The official Twitter account of the UNP quoting UNP Parliamentarian Lakshman Kiriella said the Motion of No-confidence against the Premiership of Mahinda Rajapaksa was handed over to the Speaker today.

The No Confidence Motion will be placed on the order book when Parliament next convenes.

The Motion signed by MP Lakshman Kiriella says "In terms of Articles 46(1)) and 48 of the Constitution, the Office of Prime Minister becomes vacant only if he dies, resigns, ceases to be a Member of Parliament (by removal or otherwise), or if the Statement of Government Policy or Appropriation Bill are defeated, or if a no confidence motion is passed against the Government."

Accordingly, the NCM points out that the Office of Prime Minister did not become vacant at any time after the appointment of Rani Wickremesinghe MP as Prime Minister.

Accordingly the motion noted there was no vacancy or occasion for the appointment of a Prime Minister on the 26th of October adding therefore the gazette issued in regards to the appointment becomes null and void.

The Motion states:

"AND WHEREAS on 26th October 2018, His Excellency the President has purported to appoint Mr. Mahinda Rajapaksa as Prime Minister;

This House resolves that:
1. There was no vacancy or occasion for the appointment of a Prime Minister on 26m October 2018, and as such Extraordinary No. 2094/ 43 dated 26th October 2018 and Gazette Extraordinary No. 2094/44 dated 26th October 2018 are null and void and of no force or effect in law; and
2. In Any event, this House has tic-confidence in the purported Prime Minister Mr. Mahinda Rajapaksa, or the purported government appointed on or after 26th of October 2018.
