* Sri Lanka's Supreme Court to hear appeal against Interim Order on Mahinda Rajapaksa & Cabinet on December 14th

Dec 12, Colombo: Sri Lanka's Supreme Court will hear the appeal filed against Court of Appeal's interim injunction that restrained Mahinda Rajapaksa and his cabinet from functioning in the respective posts on December 14th.

The appeal seeks an order to allow the functioning of the Cabinet until the conclusion of the hearing of the petition filed on the dissolution of Parliament.

The petition cites 122 parliamentarian of the United National Party (UNP), TNA, JVP, SLMC and ACMC, who filed the petition in the Court of Appeal, as respondents.

The Court of Appeal on 3rd December issued an interim order restraining Mahinda Rajapaksa and the Cabinet of the purported government appointed by President Maithripala Sirisena last month from functioning until the petition is heard on 12th December.

Parliamentarians of UNP, JVP and TNA on 23 November filed a Writ of Quo Warranto in the Court of Appeal challenging Mahinda Rajapaksa on continuing to hold the office of Prime Minister after a no confidence motion had been passed in Parliament against him.

Mahinda Rajapaksa in his petition told the apex court that the restraining order issued by the Court of Appeal is in violation of the constitution and pointed out that the Court of Appeal has no jurisdiction to issue such orders.

The petitioners have requested the Supreme Court to consider the appeal and declare that the interim injunction order issued yesterday by the Court of Appeal is illegal and Issue an interim order preventing the enforcement of the judgment of the Court of Appeal until a decision given on the petition.
