* Sri Lanka AG to decide whether to court martial General Fonseka

Feb 09, Colombo: After compilation of the summary of evidence, Sri Lanka's Attorney General will determine whether to court martial the arrested former Chief of Defence Staff General Sarath Fonseka, the Military Spokesman Major General Prasad Samarasinghe said today.

Addressing the media briefing held today at the Media Center for National Security, Defence Spokesman Keheliya Rambukwella said the former Army Commander was arrested Monday for violating the 57(1) clause of the Army Act.

The Spokesman said the military police are conducting inquiries into General Fonseka's alleged connections and dealings of political nature while being a member of the national Security Council which is the most powerful body in charge of national security.

Any Army officer or soldier after resigning or retiring from the Army, is bound by the Army Act for a period of six months, the Defence Spokesman added.

Answering a question the Military Spokesman said any one guilty in a Court Martial has the right to appeal against the verdict in the Court of Appeal and finally in the Supreme Court.

The Military Spokesman said General Fonseka is not hindered from exercising all his constitutional rights and he has access to his lawyer and family. He may nominate his own lawyer, the Spokesman said.

Meanwhile, the civilians already arrested by the police have been handed over to the CID for further inquiries.

General Fonseka was arrested Monday night by the military police at his office in Colombo for committing military offences.
